1. DEFINITIONS

Seller: Refers to the real or legal person who offers goods to the consumer for commercial or professional purposes, including public legal entities, or acts on behalf or account of the provider.

Consumer, Buyer: Refers to the real or legal person acting for non-commercial or non-professional purposes.

Goods/Product: Includes intangible goods such as software, audio, video, and similar materials prepared for use in electronic format, as well as tangible goods delivered via shipping by the seller for use with the program.

Service: Covers any consumer transaction other than goods supply that is performed or committed to be performed for a fee or benefit.

Distance Contract: Refers to contracts established within a system organized for the remote marketing of goods or services without the simultaneous physical presence of the seller and consumer, and concluded through the use of remote communication tools up to and including the moment of contract formation.

Permanent Data Storage: Any tool or medium (such as SMS, email, internet, disk, CD, DVD, memory card, etc.) that allows the consumer to store and access information sent by or received from them, enabling them to review the data for a reasonable period, without modification.


2. SUBJECT AND PARTIES OF THE CONTRACT

2.1 This agreement determines the rights, laws, and obligations of the BUYER, whose detailed information is provided below, regarding the sale of products and services offered by the SELLER through the website www.bright-baby.net (hereinafter referred to as the “WEBSITE”) and the delivery of products to the specified delivery address, in accordance with the Law on Consumer Protection and the Regulation on Distance Contracts. In cases where the contract does not contain a provision, relevant legal regulations apply.

2.2 The Buyer acknowledges and declares that they have read and understood all the preliminary information about the essential characteristics, sales price, payment method, and delivery conditions of the goods or services subject to sale, as well as their right of withdrawal, before placing an order. The preliminary information form on the payment page of the website and the invoice are integral parts of this contract.

4. DELIVERY

4.1 For product/service sales via the website, the delivery takes place on the specified launch date according to the nature of the service. Before the delivery, the seller sends an informational email to the address specified by the buyer. The invoice is also sent to the buyer via a permanent data storage tool. On the launch date, the seller grants the buyer electronic access and sends an email notification.

4.2 For product sales via the website, any printed supplementary materials mentioned in the program will be delivered to the address specified by the buyer within 30 days at the latest. Shipping costs are covered by the seller. If the seller fails to fulfill this obligation, the buyer may terminate the contract. In such a case, the seller must refund all collected payments within 14 days from the date of contract termination.

4.3 If the fulfillment of the order becomes impossible, the seller shall inform the buyer via a permanent data storage tool within three days and refund all payments, including any shipping fees, within fourteen days from the notification date.


5. PAYMENT METHOD

5.1 The Buyer may make installment purchases using their bank’s installment options via the website. Such installment transactions are provided directly by the relevant financial institution and do not constitute an installment sale under this contract.

6. GENERAL TERMS

6.1 The Buyer acknowledges that they have reviewed the essential characteristics, price, payment method, and delivery conditions of the products/services displayed on the website and has provided electronic confirmation.

6.2 The Buyer’s access to the products/services through the application is limited to 1 month, while access to expert consultancy services within the program is limited to the duration of the program.

6.3 The Seller is responsible for delivering the product in full compliance with the specifications indicated in the order.

6.4 If the purchased product/service does not conform to its advertised characteristics on the website, the buyer may return the item and request a full refund.

6.5 If the payment is not completed or is canceled in bank records, the seller will not be obliged to deliver the product/service.


7. RIGHT OF WITHDRAWAL

7.1 The Buyer has the right to withdraw from the contract without providing any reason or incurring penalties within 14 days from the activation date of access to the videos in the application. However, if the buyer watches the videos from the 3rd day onwards, the right of withdrawal becomes invalid. The buyer may keep the printed materials received via shipping and is not required to return them.

7.2 The buyer must submit their withdrawal request electronically via the seller’s email info@bright-baby.net within the 14-day period.

7.3 The withdrawal period begins from the date of the contract for service agreements or from the date of email confirmation for application access.

7.4 Withdrawal notifications must be sent via permanent data storage before the withdrawal period expires.

7.5 The seller will refund all collected payments, including shipping costs, within 14 days of receiving the withdrawal request.


8. FORCE MAJEURE

8.1 Events beyond the control of the parties, such as natural disasters, wars, terrorism, strikes, legislative changes, or significant technical failures, shall be considered force majeure. The affected party must inform the other party as soon as possible.

8.2 If the force majeure event lasts for 30 days, either party may terminate the contract unilaterally.


9. AGREEMENT ON EVIDENCE

9.1 In case of disputes, the Seller’s records (electronic, audio, or magnetic) will serve as conclusive evidence.


10. COMPETENT COURT IN CASE OF DISPUTE

10.1 Consumer Arbitration Committees and Consumer Courts in the jurisdiction of the buyer and seller will handle disputes, based on the value determined by the Ministry of Customs and Trade.


11. ACCEPTANCE STATEMENT

11.1 The Buyer acknowledges that they have read, understood, and accepted all terms and conditions of this contract and the Preliminary Information Form.


12. ENFORCEMENT

12.1 This contract is deemed executed and effective upon electronic approval by the buyer and completion of payment.
